TERMS AND CONDITIONS

PART 1: GENERAL

Booking a consultation constitutes acceptance of the Terms and Conditions which also services as an initial consultation retainer with the RCIC & Client.

Paying any amount of money towards a service constitutes acceptance of the Terms and Conditions on our website ubiqueimmigration.com which also serves as a retainer with the RCIC & Client.

APPLICABLE LAWS

This Agreement shall be governed by the laws in effect in the Province/Territory of Ontario and the federal laws of Canada applicable therein.

Please be advised that RCIC is a member in good standing of the College of Immigration and Citizenship Consultants (CICC). As such, the RCIC is bound by its By-laws, Code of Professional Ethics, and Regulations.

CONFIDENTIALITY

RCIC is required to preserve the confidences and secrets of the Client. This professional obligation exists to encourage candid and complete communications between the Client and the RCIC. All information and documentation provided by the Client and reviewed by the RCIC will not be divulged to any third party, other than RCIC’s agents and employees, without prior consent, except as demanded by law.

KEY TERMINOLOGIES

RCIC : Regulated Canadian Immigration Consultant

Client or Customer: Anyone who pays a fee to UBIQUE Immigration Quest for the purposes of a consultation or a service of any nature.

IRCC: Immigration Refugees and Citizenship Canada

UIQ: Abbreviation for UBIQUE IMMIGRATION QUEST.

PART 2: Initial Consultation Agreement 

The Initial Consultation Agreement is made this day between Regulated Canadian Immigration Consultant (RCIC)

Tatiana Kamtchang (the “RCIC”), Membership Number R709103

and yourself (the “Client”), for the purpose of an initial consultation relating to Canadian Immigration.


The Client is obliged to pay the booking fee as noted on the booking page. Booking and paying for a consultation constitutes acceptance of the Terms and Conditions which also services as an initial consultation retainer with the RCIC & Client.

Purpose and Scope

The purpose and scope of the consultation is to provide the consultant with sufficient information to allow for a full analysis and comprehensive advice on Canadian immigration options, including estimated time frames, application fees & representation cost (where applicable).

Limits of engagement

The services to be provided under this Agreement are limited to a single consultation on the matter described above. The RCIC shall not provide further information or advice to Client unless the Client and the RCIC have expressly agreed to a continuation with respect to this and other matters and a separate written agreement concerning those other matters has been entered into by Client and RCIC. This agreement does not obligate the RCIC to act for Client in any application or proceedings. Should a client require further advice or representation from the RCIC following this initial consultation, Client must sign a separate retainer agreement with RCIC.

Method of Consultation

Initial consultations are provided via Google Meet using the link provided in your booking confirmation email. If you did not receive this, please email info@ubiqueimmigration.com. The consultation is for the allotted time and if clients’ concerns are addressed in less time, there will be no credit or refund of unused time.

Reschedule or Missed Consultation

In the event the booked consultation date needs to change, this must be completed 24 hours before the booked consultation time by emailing info@ubiqueimmigration.com to request a new date. Consultations can only be rescheduled once. In the event, that a client is more than 15 minutes late for their appointment the appointment will be automatically canceled and there will be no refund as fees are considered earned

Cancellation policy

Appointments can be rescheduled at no cost if canceled at least 72 hours in advance. All cancellations except for a reason other than death of the client will trigger a 100% fee and as such no refund would be issued. 

Refund policy

The client is only entitled to the refund of any fees that have not been earned under this agreement. For the avoidance of doubt, fees shall be earned by the RCIC immediately on the date and time funds are received for the consultation. Fees that have been earned under this agreement are non-refundable but can be transferred from one client to one of their immediate relatives or friends

Other Conditions

Client responsibility: Client must provide the RCIC with such factual information and documentation as are required to perform the consultation. Clients must be accurate and honest and must inform RCIC of all information, even if negative or adverse, which might be relevant to the advice provided by RCIC in this matter. Failure to fully disclose all relevant information to RCIC will impact the advice given by RCIC and may void this Agreement, or seriously affect the outcome of the application of Client or the retention of any status that Client may obtain.

Advice current on date of consultation: The advice provided by the RCIC to the Client is based on the Canadian immigration law and policy current on the date of the consultation where relevant. The RCIC is not responsible or accountable for any change in government legislation or policy that may impact the processing of any subsequent application by the Client.

No guarantee on the outcome: RCIC shall provide consulting services to the Client to the standard of a competent ICCRC member. RCIC does not guarantee that she will be able to assist the Client in meeting his or her business, education, employment or immigration goals.

Confidentiality: RCIC is required to preserve the confidences and secrets of the Client. This professional obligation exists to encourage candid and complete communications between the Client and the RCIC. All information and documentation provided by the Client and reviewed by the RCIC will not be divulged to any third party, other than RCIC’s agents and employees, without prior consent, except as demanded by law.

PART 3 – Service Agreement

The RCIC is considered retained by the client in either of the following scenarios:

  •  The client pays the minimum retainer fee OR 
  • A retainer agreement is signed between the RCIC & Client

Whichever one happens first.

A minimum time frame of ten (10) business days is expected for a proper service agreement to be drafted by the RCIC for the client’s review.

The retainer Agreement is made this day between Regulated Canadian Immigration Consultant (RCIC)

and yourself (the “Client”), for the purpose of a service relating to Canadian Immigration.


The Client is obliged to pay the minimum retainer fee of $500 CAD per person as advised during the initial consultation. Paying any sum of money towards a service constitutes acceptance of the Terms and Conditions which also services as an initial consultation retainer with the RCIC & Client.

Article 1 Definitions

The terms set forth in this Professional Service Agreement shall have the meanings given  to the terms contained in the Regulations Governing the Professional Service Agreement  and by the laws of the board, which could be amended from time to time.  

Administrative Fees: Fees to be paid by the customer to the various bodies involved in the  immigration process; 

UIQ Fees: Remuneration to be paid by the customer to UBIQUE Immigration Quest for its  services; 

Disbursements: refers to the various expenses that may be incurred by UBIQUE  Immigration Quest during the provision of its services to the client, namely government  processing fees, which should be reimbursed by the said client. For the sake of clarity,  these disbursements exclude fees for consultant services; 

UIQ: UBIQUE Immigration Quest 

IRCC: Immigration, Refugees and Citizenship Canada  

CAQ: Certificat d’Acceptation du Québec (Quebec Certificate of Acceptance)  

WES: World Education Service 

EDE: Evaluation des Diplômes d’Études  

TCF: Test de Connaissance de Français 

TEF: Test d’Evaluation de Français 

IELTS: International English Language Testing System  

CICC: College of Immigration and Citizenship Consultants of Canada 

Article 2 Purpose and Scope

The purpose and scope of the service is for the RCIC to assist the client in compiling documents and applying for a Canadian immigration program on behalf of the applicant for their selected stream; visitor visa, study permits, work permits , permanent residency express entry, permanent residency provincial nomination, family sponsorship or any immigration like service. The scope of this engagement ends when a visa decision has been issued by IRCC be it an approval or a refusal. Should the client require another service other than the one agreed during or after the consultation, the client shall make a written request to the IRCC through one of the various means of communication put in place and  after which another service agreement shall be established within a minimum time frame of two 2 weeks.

Limits of engagement

The services to be provided under this Agreement are limited to a single service on the matter described above. The RCIC shall not provide further information or advice to Client unless the Client and the RCIC have expressly agreed to a continuation with respect to this and other matters and a separate written agreement concerning those other matters has been entered into by Client and RCIC. 

Article 3 UIQ Obligations

In consideration of the fees paid by the customer, and due to the aforementioned purpose,  UIQ undertakes to:  

i. Preparation  

– provide the customer with a list of the forms and documents required at the start of  each stage of the procedure;  

– advise customers on the choice of immigration procedure appropriate for their level of study, work experience, age, language skills, individual deadlines and budget.

-Where necessary, perform a WES evaluation, register the client online for language tests and coach the client as to how to effectively prepare for these tests.

ii. Step 2 Applying to the immigration program stream

Depending on the immigration procedure, the RCIC shall do the following on behalf of the client:

  • Apply to three (3) Colleges or Universities and follow up on admissions or
  • Create an Express Entry profile and submit it to IRCC or
  • Create a provincial nomination profile and submit to the province or
  • Create a job bank profile and apply for LMIA approved or exempted jobs and follow up with an LMIA application with IRCC 

iii.  Step 3 Visa application  

– Request the “Certificat d’Acceptation du Québec” (CAQ) if the customer chooses a school  located in the province of Quebec or 

– Request the “Certificat de Sélection du Québec” (CAQ) if the customer chooses a job or stream located in the province of Quebec or 

 – gather all necessary documents from the customer; 

– examine the information and documents provided on receipt of documents and forms;  – submit the visa application by the deadline set by IRCC; 

iv. File processing 

– perform various updates on the file;  

– follow up with the IRCC (Canadian government);  

– at each stage and throughout the process, to keep the customer informed of the progress  of his/her request and to forward to the customer all copies of correspondences received  or sent on his/her behalf in connection with his request;  

NB: UIQ reserves the right to cancel this contract and refuse to process any request if the  documents provided do not conform to the declarations made by the customer; 

v. Biometrics and Medical Examinations

– where appropriate, recommend IRCC-designated clinics for the various examinations or Biometrics collection centers.

vi. Visa application and decision  

– apply for a temporary or permanent visa;  

– follow the procedure through to the Visa decision. 

v. Others  

– Customer information is collected and used in accordance with CICC’s Professional Code  of conduct; 

– It also undertakes to advise the customer, in certain circumstances, that its chances of  success are not favorable, and may offer to terminate this agreement if the customer so  wishes; 

– Finally, RCIC undertakes to advise the customer of any factor likely to increase the chances of  a successful visa application, at each stage and throughout the process.  

Article 4 – Client Responsibility  

At UIQ’s request, the customer must: 

– provide all necessary documentation (Curriculum vitae, passports, certificates,  transcripts, employment contracts, pay slips, bank statements etc.) in english and/or  French (NB: Any document drafted in another language must be translated by the customer into  one of the two aforementioned languages before being transmitted); 

– put UIQ in touch with the guarantor so that the latter can provide the necessary  documentation; 

– provide accurate and honest information at every stage and throughout the process; – carry out the tasks assigned to him/her, in particular: conduct interviews with the  establishment, language test, biometrics, medical examination and interview with IRCC if  necessary; 

– immediately inform UIQ of any change in marital status, family or civil status, or of the  contact details of any person included in the application; 

– Notify UIQ immediately before applying or confirming any language tests, WES evaluations, job employment offers, University offers of admission etc

– notify UIQ immediately if contacted directly by any IRCC or a provincial government  administrator or visa office processing the application;  

– within the framework of a professional service contract with a spouse, the customer must  authorize UIQ to communicate, if necessary, with the other parties;  

Additional Client responsibility: Client must provide the RCIC with such factual information and documentation as are required to perform the service. Clients must be accurate and honest and must inform RCIC of all information, even if negative or adverse, which might be relevant to the advice provided by RCIC in this matter. Failure to fully disclose all relevant information to RCIC will impact the advice given by RCIC and may void this Agreement, or seriously affect the outcome of the application of Client or the retention of any status that Client may obtain.

Article 5 – Payment terms and exchange rates  

Payment will be made in several stages and the main currency will be the Canadian dollar  (CAD). Regardless of where the payment is to be made: 

– all payments from Canada will be subject to an exchange rate of $1 CAD = $1 CAD  – all payments from Cameroon will be subject to an exchange rate of 500 FCFA = $1 CAD .  – all payments from the United States and all other regions of the world will be subject to an  exchange rate of $1 USD = $600 FCFA.  

The total cost includes the following charges:  

  • Retainer fee per person: $ 500 CAD  to be paid immediately to retain services.
  • Service fees per person: varies from one procedure to another in the range of $2500 to $5000 for the main applicant and between $500 and $2000 for their dependents as communicated during the consultation in part 1 of this service agreement.
  • Administrative fees  – varies from procedure to procedure as communicated during the consultation in part 1 of this service agreement but usually includes the following:

VISITOR VISA

  • IRCC administrative fee: $100 CAD 
  • IRCC Biometrics: $85 CAD 
  • Flight reservation: $45 CAD (the entire purchase will be at the customer’s expense) 
  • Travel medical insurance: $520 CAD(excess if located will be charged to customer)

STUDENT VISA

  • Three (3) requests for admission: $550 CAD (the excess, if any, will be billed to the customer) 
  • IRCC administrative fee: $250 CAD 
  • Quebec acceptance certificate (if applicable): $135 CAD 
  • IRCC Biometrics: $85 CAD 
  • IRCC medical examinations: $480 CAD 

WORK VISA

  • CAQ Quebec acceptance certificate (if applicable): $250
  • IRCC administrative fee: $155
  • IRCC biometrics: $85
  • IRCC medical exams: $480

PERMANENT RESIDENCY EXPRESS ENTRY 

  • IRCC administrative fee: $1365 CAD 
  • WES diploma evaluation fee: $300 CAD 
  • IRCC Biometrics: $85 CAD 
  • IRCC medical examinations: $480 CAD 

PERMANENT RESIDENCY PROVINCIAL NOMINATIONS

  • Provincial selection (varies by province) 
  • IRCC administrative fee: $1365 CAD 
  • WES diploma evaluation fee: $300 CAD
  • IRCC Biometrics: $85 CAD 
  • IRCC medical examinations: $480 CAD 
  • Job search fee: $2000 CAD

PERMANENT RESIDENCY QUEBEC ARRIMA

  • IRCC administrative fees: $1365
  • IRCC biometrics: $85
  • Certificat de sélection du Québec CSQ (if applicable): $870
  • Study diploma evaluation: $150
  • IRCC medical exams: $480

NOTE:

These prices are subject to change without notice but will be updated accordingly on this website and or on your service agreement contract within a period not exceeding 45 days of the said change. 

Other conditions  

– The customer agrees that all sums paid in execution of this contract shall be paid by the methods of payment set forth below. Any payment made by the customer in any other  hands or by any means other than those specified below shall not be binding to UIQ and  shall be the sole responsibility of the customer. 

 ****As stated in article 4, the customer must provide the consultant with accurate and  honest information at every stage and throughout the procedure. In the event of new information  during the process, or information that has been withheld by the client and that has not been dealt  with in advance, even though it has an impact on the procedure, the invoice will be increased by  $150 per hour, all of which will affect the total cost of the procedure.**** 

– The customer accepts that conditional payment is not authorized as a billing method by  CCIC and therefore payment is not subject to visa approval.  

– The amount agreed between the parties corresponds to the cost of processing the file of  one person (the aforementioned customer), and will be subject to change in the event  of the addition of one or more other persons, by mutual agreement between the parties. 

Article 6 – Payment schedule and invoicing  

UIQ will issue invoices to the customer which will include: the customer’s name and  address, a list of services already rendered, the date or dates on which the services were  rendered, and the total charges applicable to the fees for the services rendered. Said  invoices will be provided in accordance with the payment terms set out in article 6;  

Additional pricing information 

All previous visas will trigger an additional cost of at least $1000 to review previous documents submitted and this fee may increase based on the number of visa refusals, the destination country and the information provided which led to such refusal.

Article 7 – Invoicing and payment methods  

The customer will be invoiced on a fixed-fee basis, with payment made in stages as  indicated in advance. An hourly rate of $150 per hour may be charged to the customer for any non standard work performed on their file due to information previously not disclosed to the IRCC or due to new change in personal situation which would result in significantly more work or effort on the part of the RCIC. This includes but is not limited to birth of children, marriage or divorce from spouse, death of an immediate relative, change of employment, failing to meet the GPA required for admissions or the score required at the language tests.

All payment processing fees will be charged to the customer.

Article 8 Processing times

UIQ processing times will vary from one milestone to the next. Approximate time frames include:

i) Preparation: Can only be estimated based on the time the client takes to gather all the required documentation.

ii) Application to the specific stream (admissions, jobs, Express entry, provincial nominations etc):  UIQ will complete this step about 2 to 3 weeks after all the required documents have been received

iii) Visa application:  UIQ will complete this step about 2 to 4 weeks after all the required documents have been received .

iv) File processing: 

Visa processing times vary from one immigration procedure to another and can be verified on the IRCC website here:

File processing times also depend on how much time the client takes to complete the biometrics and medical exams where required. 

NOTE: Timeline for admission letter decisions, job offer notices, express entry and provincial nomination selections vary based on the various institutions or government bodies involved and can be verified directly on their respective websites. Processing times are also affected by the client’s profile (age, work experience, education level and language skills) and an estimate will be provided during part 1 of the service agreement “The consultation”.

NOTE: These processing times are subject to change without notice but will be updated accordingly on this website and or on your service agreement contract within a period not exceeding 45 calendar days of the said date change. 

Article 9 Cancellation and refund policy 

The customer acknowledges that obtaining a visa or any other immigration document, as well as the time required to process this request, is at the sole discretion of IRCC and government authorities and not of UIQ. In other words, the customer acknowledges that the fees are non-refundable in the event that the visa is refused; If the visa is refused due to a fault attributable to the customer, the fees already paid by him/her will not be reimbursed; If, on the other hand, if the fault is attributable to UIQ, the latter is obliged to repeat the same procedure, or to propose another procedure to the customer:

– In the first case, i.e. where the customer chooses to repeat the same procedure, all related costs (excluding administrative costs) will be borne solely by UIQ ;

– In the second case, where a different procedure is chosen, the fees will have to be treated with respect to article 7 of these terms and conditions. 

– In the event of the customer’s voluntary withdrawal, any fees already paid will not be reimbursed.

The client is not entitled to the refund of retainer fees or consultation fees as they are considered to be earned as soon as they are received. These fees are therefore non refundable but can be transferred from one client to one of their immediate relatives or friends.

Article 10 – Dispute resolution

In the event of disputes between the parties, they must try as far as possible to reach an amicable settlement.

In the event of non-payment, the customer must submit a written complaint to UIQ, which must be resolved within thirty (30) days.

Article 11 Confidentiality and Method of Communication

The primary means of communication will be via email using the address info@ubiqueimmigration.com through which the RCIC is obliged to respond to the client in a maximum time frame of five (5) business days. Any other methods of communication including SMS, WhatsApp or word of mouth are considered secondary and would not be prioritized over email.

– UIQ undertakes to take all necessary precautions to maintain the confidentiality of the file and of the customer’s personal and financial information at every stage and throughout the process, using it only internally for the advancement of the procedure.

– All information and documents reviewed by UIQ, required by IRCC and all other governing bodies, and used to prepare the application will not be disclosed to any third party except with the prior consent of the client, or as required by law by the College of Immigration and Citizenship Consultants of Canada;

– UIQ, and all its agents, are also bound by confidentiality requirements in accordance with the Code of Ethics of the College of Immigration and Citizenship Consultants of Canada;

The customer agrees that communications will take place electronically, preferably by email, “info@ubiqueimmigration.com” and the frequency of replies to customer messages will be five (5) working days. UIQ will make every effort to ensure a high level of security for electronic communication and information storage.

Article 12 – Force majeure

In the event of UIQ’s inability to comply with any provision of this Professional Service Agreement, due to conditions beyond its control such as, but not limited to, governmental restrictions or subsequent legislation, war, strikes or natural disasters, this agreement shall not be deemed to be breached;

Article 13 – Absence of the consultant

If the customer is unable to contact the consultant or her designated representative Gunel Sotonova R709277 BN IMMIGRATION soltanova_gunel@yahoo.com +1647-614-1854 and has reason to believe that the consultant is deceased, incapacitated or otherwise unable to to fulfill her obligations, the customer shall contact CICC as a last resort in accordance with article 10 of this agreement.

Article 14 – Policy change

The client agrees that as a result of a request made to UIQ to represent him in a matter

other than that mentioned in this contract, a change in his material circumstances, material facts not disclosed at the outset of the request or a change in government legislation concerning the processing of immigration or citizenship applications, the contract may be modified accordingly;

Article 15 – Commencement and end of contract

IN EFFECT

This contract will begin on the first occurrence of any of the following:

  •  The client pays the minimum retainer fee 
  • A retainer agreement is signed between the RCIC & Client

The RCIC is considered retained by the client in either of the above scenarios. Paying for a service constitutes acceptance of the Terms and Conditions on our website ubiqueimmigration.com which also serves as a retainer with the RCIC & Client. 

A minimum time frame of ten (10) business days is expected for a proper service agreement to be drafted by the RCIC for the client’s review.

TERMINATION

This contract will terminate on the first occurrence of any of the following:

– when the tasks mentioned in article 3 have NOT been carried out by both parties.

– should any material changes occur in the application or in the customer’s eligibility that would prevent UIQ from fulfilling its obligations;

– the customer obtains a decision on his visa application and is informed of this by the consultant.

– the consultant is released by the customer and has paid any outstanding fees or Disbursements.

Article 16 – Conservation of documents

UIQ cabinet will keep the customer’s les for a maximum of 12 months after the end of the

Contract.

Article 17 – Release from mutual obligations

– The customer may at any time release UIQ from its obligations and terminate the contract in writing and will be entitled to receive all documents related to his or her immigration file.

– In accordance with article 11 of the CICC Code of Professional Ethics, UIQ may withdraw from a case and terminate the contract in writing if the client’s le may be prejudicial to

the consultant’s profession.

– In both of the above cases, unpaid fees or disbursements will be paid by the Customer to UIQ within a maximum period of 30 calendar days. Unused and/or unearned fees will be reimbursed to the Customer by UIQ within a period of time consistent with article 9 of this engagement.

Article 18- Miscellaneous

– The customer explicitly authorizes UIQ to act on his behalf, within the limits of the specific functions for which UIQ’s services have been retained;

– This agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements, understandings, warranties,representations, negotiations and discussions, oral or written, of the parties except as specifically set forth herein;

– This contract is binding upon the parties hereto and their respective heirs, administrators, successors and assigns;

– This contract may only be modified if the changes are made in writing and signed by the parties concerned;

– The provisions of this contract are deemed severable. If any provision of this contract

is held by a court of competent jurisdiction to be unenforceable, the provision shall be severed from this contract, and the remaining provisions shall remain in full force and effect.

– The headings used in this contract are for convenience only and are not to be construed as additions to or limitations of the covenants and agreements contained herein;

– Each party to this Agreement shall do, make, give, execute or cause to be done, made, given or executed all such other things, assurances and all such deeds, conveyances and documents as may be deemed necessary or reasonably required, to fully and effectively carry out the intent and purpose of this Agreement;

– The customer agrees that he/her has had sufficient time to review this contract, and that it has been given the opportunity to obtain independent legal advice and

translation prior to the signing and delivery of this contract. If the customer has not sought independent legal advice prior to the signing and delivery of this contract, it has done so of its own will without undue pressure and agrees that the failure to obtain

independent legal advice shall not be used as a defense to enforce the obligations created in this contract;

– Any false declaration constitutes grounds for exclusion from Canadian territory for a period of five (5) years in accordance with section 40 of the Immigration and Refugee Protection Act.

– The customer acknowledges having received a copy of this contract and agrees to be bound by its terms.

Article 19 Change of service

In the event the service needs to be changed by the client, this must be communicated as soon as possible to the RCIC by emailing info@ubiqueimmigration.com to request a new service. All fees already earned from the previous service would not be refunded. For the purpose of avoidance of doubt, fees for each milestone of the procedure are earned when the RCIC has performed their duties leading to completion of that milestone. The fees of the new service will be calculated based on the standard fees for that service less any fees already earned from the milestone of the previous service procedure provided that milestone equally applies to the new chosen service. If there are no milestones in common between the previous and new service, the client is expected to pay the full price of the new service.

Article 20 Transfer of client file to another Consultant

If the client chooses to have their file transferred to another Licensed Immigration Consultant, the client must communicate that in writing to the RCIC and expect at least 30 days for the transfer to be finalized. The email must be sent to info@ubiqueimmigration.com stating the name of the new RCIC, their membership number, the name of their organization, their email address, phone number. All fees already earned from the previous service would not be refunded. For the purpose of avoidance of doubt, fees for each milestone of the procedure are earned when the RCIC has performed their duties leading to completion of that milestone. All fees not earned will be reimbursed to the client within a period of 30 calendar days

By signing the agreement, you will be indicating your agreement to the terms and conditions set forth above in the initial Consultation Agreement or service agreement (whichever is applicable) and acknowledge that any further engagement of the RCIC will require a further written agreement with new or different terms.
